Resumen

En el marco del delito de bigamia tenía vital importancia la práctica de la prueba denominada «Justificación de matrimonio» la cual tenía por objeto demostrar la celebración de determinado matrimonio en el distrito inquisitorial en el que se llevaban a cabo las diligencias. Esta práctica podía iniciarse a raíz de una denuncia en el propio tribunal o a partir de la petición realizada desde otro tribunal de distrito. Con el objeto de comprender la importancia de la misma y su dificultad, es necesario también abordar el estudio del perfil del bígamo y de la correspondencia que mantuvieron el tribunal canario y los tribunales americanos, a partir de principios del siglo XVII y hasta mediados del siglo XVIII, momento en que la Suprema prohibió este tipo de contactos directos y obligó a que la correspondencia se mantuviera a través de ella.

In the context of the crime of bigamy, it was very important the practice of the evidence called «Justification of marriage», which was intended to demonstrate the celebration of a certain marriage in the inquisitorial district in which the proceedings were carried out. This practice could be initiated following a complaint in the court itself or from the request made by another district court. In order to understand the importance of it and its difficulty, it is also necessary to address the study of the profile of the bigamist and the correspondence maintained by the Canary Inquisitorial Court and the American Inquisitorial Courts, from the beginning of the 17th century until the mid-eighteenth century,at which time the Supreme banned this type of direct contact and forced the correspondence was maintained through it.
