Resumen

La orden franciscana tuvo un importante papel en la historia religiosa e ideológica de las islas Canarias tras su conquista y durante la Edad Moderna. El principal propósito de este artículo es el estudio de las demandas interpuestas por las clarisas y los franciscanos ante los jueces seglares en Tenerife durante los siglos XVII y XVIII. La finalidad de los miembros de esa orden fue la preservación y el acrecentamiento de su patrimonio, en un contexto social de desigual acceso a la propiedad y uso del suelo. Las cantidades adeudadas fueron motivo de numerosas querellas interpuestas ante la jurisdicción real. Las fuentes más importantes de nuestro ensayo son los expedientes judiciales custodiados en el Archivo Histórico Provincial de Tenerife. Asimismo prestamos especial atención a la práctica jurídica de ese período histórico.

The Franciscan order had an important role in the religious and ideological history of Canary Islands after its conquest and during the early modern age. The main purpose of this article is the study of the lawsuits of the Poor Clares and Franciscans before the secular judges in Tenerife during the XVII and XVIIIth centuries. The aim of the members of that religious order was the preservation and the enhancement of its heritage, under the social context of unequal access to the ownership and the use of the soil. The unpaid debts were the reason of several complaints before the royal jurisdiction. The most important sources of our essay are the judicial records belonging to the Archivo Histórico Provincial de Tenerife. Furthermore, we pay special attention to the juridical practice of that historical period.
